SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address. When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system. Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.

SECTION 2 - CONSENT

How do you get my consent? 

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only. 
If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

How do I withdraw my consent?

SECTION 3 - DISCLOSURE

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction. We may disclose personal information that we collect or you provide as described in this Privacy Policy:

  • To entities that are owned by or affiliated with Mirth Caftans LLC;
  • If you are applying for a Facilitator account, to third parties in order to verify information you have provided to us;
  • To Facilitators and Third-Party Hosts to the extent you have signed up to attend Events that they are hosting;
  • To contractors, service providers, and other third parties we use to support the Website and our operations.  For example, Mirth Caftans LLC may share your information with entities and persons that provide services to Mirth Caftans LLC, including web hosting, web analytics, data analysis, advertising, marketing, accounting and tax preparation services, credit card processing, market research, risk management and other services, software and technologies. Whenever possible, Mirth Caftans LLC restricts the ability of these entities and persons to use information about you that Mirth Caftans LLC provides to them for purposes other than providing services to Mirth Caftans LLC and complying with applicable laws.  Please note that personal information of Website users is stored on servers owned by other companies, and in databases that are managed by other companies, but are made available to us through user services or contractual agreements.  Mirth Caftans LLC does not sell or license for a fee your personal information.  In addition, Mirth Caftans LLC processes credit card transactions through third party payment gateways which are managed by reputable third parties;
  • To third party service providers and referral partners that work on behalf of or with us to provide some aspect of the services provided through the Website, and to help us communicate with you or to provide Facilitators with ancillary services offered by such service providers and referral partners;
  • To a buyer or successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Mirth Caftans LLC’s assets, in which personal information held by Mirth Caftans LLC about our Website users is among the assets transferred.  If Mirth Caftans LLC makes a sale or transfer of assets to any third party, or is otherwise involved in a merger, acquisition, change of control or asset transfer, Mirth Caftans LLC may transfer your information to one or more third parties as part of, or in connection with, that transaction;
  • For any other purpose disclosed by us when you provide the information; and
  • With your consent. 

We may also disclose your personal information to: 

  • Protect and enforce the legal rights of Mirth Caftans LLC, its licensors and services providers, and of the users of the Website; 
  • Protect the safety and security of users of the Website, and that of Mirth Caftans LLC’s employees, affiliates, agents, licensors and service providers; 
  • Prevent fraud and for risk management purposes;
  • Comply with applicable laws (including applicable tax and privacy laws) or respond to legal process or a request for cooperation by a government entity, whether or not legally required; and/or
  • To ensure your compliance with our policies, and to enforce our Terms of Service and other applicable agreements.

SECTION 4 - SHOPIFY

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

Payment

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers. For more insight, you may also want to read Shopify’s Terms of Service here or Privacy Statement here.

SECTION 5 - THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So, if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act. Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

Additionally, Mirth Caftans LLC likes to interact with you on third party sites, including without limitation on social media platforms like Facebook, Meta, Instagram, Google, Twitter, TikTok and videoconferencing platforms such as Zoom (collectively, the “Third-Party Sites”) where we post messages, images and other content, or invite feedback.  Except as expressly stated, this Privacy Policy does not cover the privacy practices of those Third-Party Sites, or any other service providers, persons, entities, platforms or services that Mirth Caftans LLC does not own or control. You should check the privacy policies of Third-Party Sites before providing personal information to or through Third Party Sites. This Privacy Policy describes the information Mirth Caftans LLC collects when you visit the Website or otherwise contact us (including via email or the telephone), and how Mirth Caftans LLC uses, shares and protects that information.  This Privacy Policy does not apply to information collected by any third party (including any third-party owner of a social media site on which we post content), including through any application, blog, social media site or content (including advertising) that may link to or be accessible on the Website.

If you establish a relationship with a Facilitator whose profile is advertised on the Website, including a therapist-patient relationship, attend an Event that is hosted by a Facilitator or third party organization (including schools and community organizations) (each a “Third-Party Host”) or otherwise share personal information (including health-related information) with a Facilitator, Third Party Host or other participant at an Event or otherwise, this Privacy Policy does not govern what such Facilitator, Third Party Host or other participant may do with such information. Please note that Mirth Caftans LLC does not own, employ or control Facilitators, Third Party Hosts or other Event participants.  We urge you to not disclose any sensitive personal information (including regarding any mental health condition that you or your family members or friends might have) or other confidential information to such Facilitators, Third Party Hosts or Event participants.  If you do decide to disclose personal information to any of the foregoing, you do so at your sole risk and Mirth Caftans LLC cannot guarantee, and makes no representations or warranties with respect to, the handling or processing of such information by any Facilitator, Third Party Host or other Event participant.

SECTION 6 - SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

SECTION 7 - COOKIES

Here is a list of cookies that we use. We’ve listed them here so you that you can choose if you want to opt-out of cookies or not. 

  • _session_id, unique token, sessional, Allows Shopify to store information about your session (referrer, landing page, etc). 
  • _shopify_visit, no data held, Persistent for 30 minutes from the last visit, used by our website provider’s internal stats tracker to record the number of visits 
  • _shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, Counts the number of visits to a store by a single customer. 
  • cart, unique token, persistent for 2 weeks, Stores information about the contents of your cart. 
  • _secure_session_id, unique token, sessional 
  • storefront_digest, unique token, indefinite If the shop has a password, this is used to determine if the current visitor has access.

SECTION 8 - AGE OF CONSENT

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

SECTION 9 - CHANGES TO THIS PRIVACY POLICY

This Privacy Policy may change from time to time. It is our policy to post any changes we make to this Privacy Policy on this page with a notice that this Privacy Policy has been updated on the Website home page. If we make material changes to how we treat our users’ personal information, we will notify you through a notice on the Website home page or other reasonable method.  You can determine when this Privacy Policy was last revised by referring to the “Last Updated” legend at the top of this page.  Any changes to this Privacy Policy will become effective upon posting of the updated Privacy Policy.  Your continued use of the Website after we make changes is deemed to be your acceptance of those changes, so we encourage you to periodically review this Privacy Policy to ensure your familiarity with the most current version of it. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Website and this Privacy Policy to check for any changes. If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.

SECTION 10 – TYPES OF INFORMATION WE COLLECT ABOUT YOU AND HOW WE COLLECT IT

We collect several types of information from and about users of our Website, including information:

  • By which you may be personally identified, such as your name, mailing address, email address, telephone number, and other identifiers by which you may be directly or indirectly identified or contacted online or offline (collectively, your “personal information”);
  • We need to verify your educational background and qualifications to act as a Facilitator if you are applying to be a Facilitator and for a Facilitator account;
  • That is about you but does not individually identify you, such as the type of browser you are using, the actions that you take while you visit our Website (including search terms you enter on the Website and web pages you view) and the geographic location of your Internet Protocol (“IP”) address;
  • About your internet connection, the equipment you use to access our Website, and Website usage-related information such as your IP address, and information collected through cookies, web beacons and other tracking technologies, as further described below; and
  • About your mobile device, as well as metadata and other information associated with files stored on your device (for example, photographs, audio and video clips, personal contacts, and address book).

We collect this information directly from you when you provide it to us, automatically as you access and navigate through the Website, and from third parties, such as our business partners and service providers.

A.  Information You Provide to Us

The information we collect on or through our Website may include:

  • Information that you provide by filling in forms on our Website or contacting us via the telephone, email or the Website, including your name, email address, standard caller identification information and the content of your message. This includes information you provide when you register for an Event or web conference (regardless of whether such registration is successful) send questions or comments to us via email or in response to a survey, subscribe to our newsletter or sign-up to receive information and other communications from Mirth Caftans LLC (including regarding Events, Facilitators and our mission and activities). We may also ask you for information when you report a problem with our Website; 
  • Information provided by individuals who are applying for a Facilitator account (including without limitation their names, addresses, phone numbers, email addresses, information about their education, qualifications, background, interests, geographic location, and payment details to authorize automatic and recurring payments for their membership fees, etc.);
  • Information that you provide when you sign up to attend an Event, inquire about an Event, Third Party Host or Facilitator, make a donation through our Website or otherwise, or purchase a ticket to an Event or other event we are organizing, sponsoring or promoting.  This information could include your email and billing address, telephone number, and payment details (including your credit card information) and other information we need to process the applicable transaction; and
  • Information that you provide when you submit reviews, testimonials or other public comments through the Website, including regarding Facilitators and Events.  The information submitted may include your email address, name, biography and other content.  This information may be shared with Facilitators and may be made public in any form (subject to any edits that Mirth Caftans LLC may deem appropriate) at the sole discretion of Mirth Caftans LLC.

You represent and warrant that you have the right to provide Mirth Caftans LLC with all information that you submit to us through the Website or otherwise (including information about your property if you are a Third-Party Host, and all information, content, data and materials that you provide to us in connection with your application for a Facilitator account).  You also represent and warrant that the disclosure of all information you provide to Mirth Caftans LLC on or through the Website or otherwise does not violate the Payment Card Industry Data Security Standards (“PCI-DSS”), Health Care Privacy Laws (as defined below), the General Data Protection Regulation (EU) 2016/679 (the “GDPR”) or any other law or regulation, including any state privacy laws.  In addition, you represent and warrant that all such information you provide to Mirth Caftans LLC is true, correct and complete as of the date provided and does not contain any statement that is false, deceptive or misleading. You grant Mirth Caftans LLC permission to store all information you submit to Mirth Caftans LLC in accordance with this Privacy Policy and grant Mirth Caftans LLC permission to verify the accuracy of all such information.

B.  Information We Collect Using Automatic Data Collection Technologies

As you navigate through and interact with our Website, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and Website usage patterns, including: (i) details of your visits to our Website, including traffic data, location data, information recorded on website logs, and other communication data and the resources that you access and use on the Website; (ii) information about your computer or mobile device and internet connection, including your IP address, operating system, browser type, your device's unique device identifier, mobile network information, and (iii) in the case of mobile applications, access to metadata and other information associated with files stored on your device (for example, photographs, audio and video clips, personal contacts, and address book).

The information we collect automatically may include personal information, and we may maintain it or associate it with personal information we collect in other ways or receive from third parties.  It helps us to improve our Website and to deliver a better and more personalized service, including by enabling us to: learn more about how people use our Website; estimate our audience size and usage patterns; store information about your preferences in order to customize our Website according to your individual interests; speed up your searches; and recognize you when you return to our Website.

The technologies we use for this automatic data collection may include:

  • Cookies (or browser cookies). Web beacons can be embedded in web pages, videos, or emails, and can allow a web server to read certain types of information from your browser, check whether you have viewed a particular web page or email message, and determine, among other things, the time and date on which you viewed the web beacon, the IP address of your computer, and the URL of the web page from which the web beacon was viewed.  We and our partners use web beacons for a variety of purposes, including to analyze the use of the Website and in conjunction with cookies to improve the Website and to provide you with more relevant information and content.

Mirth Caftans LLC may use automated devices and applications provided by third parties, such as Google Analytics and other tools provided by third parties, to evaluate usage of our Website and the services offered through our Website.  We use these tools to help us improve our services, performance, communication and user experiences.  These entities may use cookies and other tracking technologies which collect information to perform their services. We do not share personal information that we collect directly with these third parties. However, these third parties may collect personal information directly through the use of cookies and other tracking technologies on or through our Website.  For an explanation of the information collected by these third parties and their respective privacy policies, go to the Google Analytics privacy policy and/or the privacy policies of the applicable Third-Party Sites.  

Mirth Caftans LLC may also use cookies, web beacons and other automated technologies to collect information about your online activities over time and across Third Party Sites or other online services (behavioral tracking).  For additional information about your choice regarding how we use and disclose information collected from you, please see Section 5 below entitled “Choices About How We Use and Disclose Your Information”.

SECTION 10 – HOW WE USE YOUR INFORMATION

We use information that we collect about you or that you provide to us, including any personal information:

  • To communicate with you and to administer the services provided through the Website and for our internal analysis of site usage; 
  • To give you access to and allow you to use the Website and its interactive features, functionality and content; 
  • To provide users with certain information regarding Facilitators 
  • To invite you to apply to be a Facilitator as applicable;
  • To verify the accuracy of information you have provided, including with respect to any application you submit for a Facilitator account;
  • To respond to messages that are sent directly to us, monitor the security of the Website, and administer the Website;
  • To provide you with (a) information regarding Facilitators, our mission and certain events and activities that we sponsor, promote and/or organize, such as Events and goods and services that may be of interest to you, and (b) promotional materials regarding Mirth Caftans LLC’s mission; 
  • To fulfill the purposes for which you provided us with the information (such as processing a transaction);
  • To ensure the functionality and usability of the Website, and to install and monitor elements of the Website for information security and/or fraud prevention purposes and to monitor for spam or other content that is violation of our Terms of Service;
  • To improve the Website by, for example, learning more about what information users find interesting or useful and analyzing and learning about the Website’s user base as a whole;
  • To internally analyze trends and track users’ movements around the Website and referral websites;
  • To ensure compliance with the Terms of Service for the Website;
  • To carry out our obligations and enforce our legal rights;
  • To notify you about changes to our Website; and
  • For any other purpose disclosed to you at the time Mirth Caftans LLC collects your information, or otherwise with your consent.

We may store information subject to this Privacy Policy ourselves, or it may be included in databases owned and maintained by our respective affiliates, agents and/or service providers. We may use such information and pool it with other information to determine, for example, the total number of visitors to the Website, the number of visitors to each page of the Website and the domain names of our visitors’ internet service providers. To better serve you and improve our Website, we may conduct (and we may engage third parties to conduct) research on demographics, interests, and behavior based on personal information and other information provided via the Website or otherwise. This research may be compiled and analyzed on an aggregate basis and we may share de-identified aggregate information with our affiliates and service providers. This aggregate information does not identify you personally.

We may use the information we have collected from you to enable us to display advertisements to our advertisers’ target audiences.  Even though we do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

Our Terms of Service prohibits Facilitators and other third parties from using any information they obtain on or through the Website, or from a Event participant (including the names and email addresses of Event participants) for any purpose other than to provide a Event or other applicable service to Mirth Caftans LLC without the express written consent of Mirth Caftans LLC and any individual consent required under applicable law.

SECTION 11 – LINKS TO THIRD PARTY WEBSITES

The Website may contain links to certain third-party websites or applications. We do not own, control or operate such linked sites and we are not responsible for the privacy policies or practices of such linked sites. Privacy policies and practices for such linked sites may differ from this Privacy Policy and our practice. Your access and use of such linked sites is entirely and solely at your own risk. We urge you to read the privacy policies of such linked sites before disclosing your personal information on such sites. Similarly, we cannot control how your data is collected, stored, used or shared by Third Party Sites. Please be sure to review the privacy policies and privacy settings of such Third-Party Sites (including social networking sites) to make sure you understand the information they are sharing. If you do not want a Third-Party Site to share information about you, you must contact that site and determine whether it gives you the opportunity to opt-out of sharing such information. Mirth Caftans LLC is not responsible for how these third parties may use information collected from or about you.

SECTION 12 – THIRD-PARTY CONTENT, FUNCTIONALITY AND SERVICES

Some of the content, functionality, and services on the Website may be provided by third parties that are not affiliated with Mirth Caftans LLC.  For example, Mirth Caftans LLC’s newsletter database, Website and email are maintained on third party servers owned by companies with different privacy policies from that of Mirth Caftans LLC.  Mirth Caftans LLC may also use third-party services to provide mobile applications. These types of entities may collect or receive certain information about your use of the Website or functionality linked to the Website and other information, including through the use of cookies, web beacons and similar technologies.  These entities may collect this information over time and combine such information with information collected from different websites, third parties and online services.  This Privacy Policy does not cover the use of any cookies or any other information gathered by such third parties on, through or in connection with the Website.  Mirth Caftans LLC is not responsible for the privacy practices of these entities and Mirth Caftans LLC has no control over, and Mirth Caftans LLC expressly disclaims any liability for, how they use your personal information.

SECTION 13 – DATA SECURITY

Mirth Caftans LLC uses reasonable physical, technical, and administrative measures to safeguard information in Mirth Caftans LLC’s possession against loss, theft, unauthorized use, disclosure, and/or modification or any transactions.  Please note, however, that no data transmission or storage can be guaranteed to be 100% secure.  Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.  There is always a risk that third parties may unlawfully intercept transmissions.  For example, we cannot ensure the security of your data during transmission to us or the security of your data on an iPhone or android or other device or on your Twitter page or on another computer.  This is true of all Internet and data transmissions.  As a result, while Mirth Caftans LLC strives to protect the information it maintains, Mirth Caftans LLC cannot and does not ensure, represent, warrant or guarantee the security of any information that you transmit to Mirth Caftans LLC or its affiliates (whether through the Website or otherwise, including over email or the telephone). 

By disclosing your email address to us for any reason, you are expressly consenting to receive electronic (including email) notice from us in the event of any security breach.

We or our third-party payment processors use Secure Sockets Layer (SSL), the industry-standard encryption technology for internet transmission of credit card information you provide to us through our Website. When the letters “http” in the URL change to “https”, the “s” indicates that you are in a secure area employing SSL.  Also, your browser may give a pop-up message stating that you are about to enter or leave a secure area.  Using a browser that is SSL capable will ensure that your information is encoded/encrypted when it is sent over the Internet.  Mirth Caftans LLC does not directly store, process or transmit bank account and credit card information.  All payment processing and collection of account data is accomplished on the Website via an integration with third-party service providers.  These providers are contractually required to maintain compliance with PCI-DSS and other applicable payments laws, rules and regulations.

The safety and security of your information also depends on you.  In the event we give you (or where you have chosen) a password to access certain parts of our Website, you are responsible for keeping this password confidential and for maintaining the security of your account.  We ask you not to share your password with anyone. In order to protect the security of your account, you should also sign off your account and close your browser window when you have finished your visit in order to prevent other people from accessing your account without your permission.  Please also let us know in a timely manner if there is any unauthorized use of your account or password.  We reserve the right to delete any user account that we believe in good faith and in our sole discretion presents a security risk or is not in compliance with our policies.  We also urge you to be careful about giving out personal information in public areas of the Website if applicable.  The information you share in public areas may be viewed by any user of the Website.  Please also see our Terms of Service for additional information regarding the terms and conditions applicable to your use of the Website.

SECTION 13 – CHILDREN’S INFORMATION

Our Website is not intended for children under 18 years of age.  No one under the age of 18 may provide any personal information to or on the Website. We do not knowingly collect personal information from children under 18.  If you are under 18, do not use or provide any information on the Website or through any of its features, register on the Website, make any donations through the Website, use any of interactive or public comment features of the Website, or provide any information about yourself to us, including your name, address, telephone number, email address.  If we learn we have collected or received personal information from a child under 18 without verification of parental or guardian consent, we will delete that information.  If you believe we might have any information from or about a child under 18 without parental or guardian consent, please contact us at [email protected].

If you are a resident of certain states that have enacted privacy laws (including California, USA), under 18 years old and have provided personal information to us, please see Section 6 above entitled “Accessing and Correcting Your Information” for additional information on how you can request that we delete such personal data. 

SECTION 14 – INTERNATIONAL USERS

The Website is intended to be used only by persons located in the United States or Canada.  If you are visiting the Website from outside the United States or Canada, please note that any data you provide will be transferred outside the European Union or such other non-United States or Canadian territory for use by us for any of the purposes described herein.  By providing any data to us, and using the Website, you hereby consent to such transfers of your data to the United States and Canada and the treatment of such data in accordance with applicable law.  

SECTION 15 – DISPUTE RESOLUTION

If you have any questions or concerns, please contact Mirth Caftans LLC by email at [email protected].  We will do our best to address your concerns.  If you feel that your concerns or complaint, as applicable, has not been adequately addressed, we invite you to let us know so that we can investigate further.  If we are unable to reach a resolution to the dispute, you and Mirth Caftans LLC will settle the dispute exclusively as set forth in the Terms of Service.

SECTION 16 – QUESTIONS AND CONTACT INFORMATION
